1. Scope

These General Terms and Conditions (GTC) apply to all orders placed through the MontreClaire online store. Any differing terms and conditions of the customer will not be recognized unless MontreClaire expressly agrees to their validity in writing.

3. Conclusion of Contract

The presentation of products in the online store does not constitute a binding offer, but rather an invitation to place an order.

By clicking the "Buy now" button, you are submitting a binding offer to purchase the products in your shopping cart.

Confirmation of receipt of your order will be sent by email immediately after submission.

The binding purchase contract is concluded once we accept your order by sending a shipping confirmation email.

4. Prices and Payment

All prices listed at MontreClaire are final prices and include applicable VAT where required by law.

Payments can be made by credit card, PayPal, Klarna, or other available payment methods specified at checkout. The amount will be charged at the time of order completion.

5. Delivery and Shipping

5.1 Delivery Times

Delivery times are displayed during the checkout process. Unless otherwise specified, delivery typically takes 7 to 14 business days after payment confirmation.

5.2 Shipping Costs

Shipping costs are transparently displayed during checkout and vary depending on delivery location, weight, and package size.

5.3 Delivery

Delivery will be made to the address provided by the customer. It is essential that an authorized person is available to receive the goods.

If delivery is not possible, the carrier may attempt redelivery or deliver the goods to a pickup point.

5.4 Retention of Title

Products remain the property of MontreClaire until full payment has been received.

6. Right of Withdrawal

6.1 Statutory Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period expires 14 days after the day on which you, or a third party designated by you (other than the carrier), take physical possession of the goods.

6.2 Consequences of Withdrawal

If you cancel the contract, we will refund all payments received, including delivery costs (except for any additional costs incurred if you chose a delivery method other than the cheapest standard delivery option), within a maximum of 14 days after receiving the returned products.

The refund will be made using the same payment method used in the original transaction.

6.3 Return of Goods

Products must be returned undamaged, unused, and in their original packaging. Please include the order confirmation or invoice number so we can process your return.

7. Warranty

All products offered at MontreClaire are subject to statutory warranty rights of 2 years in accordance with applicable EU consumer protection law.

If an item is defective, you may request repair or replacement within two years of receiving the goods.

These Terms and Conditions are governed by the laws of the State of Wyoming, United States, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

For consumers residing in the European Union, the mandatory consumer protection laws of the country in which you reside remain applicable and unaffected by this choice of law.
